The Supreme Court in a 6-2 decision Tuesday upheld a rule that allows the Environmental Protection Agency to regulate air pollution from power plants that crosses state lines, handing a major victory to President Obama.
The rule requires 28 states in the East, Midwest, and South to cut back on sulfur and nitrogen emissions from coal-fired power plants that “contribute significantly” to air problems in other states.

U.S. Environmental Protection Agency (EPA) air emission regulations have helped facilitate the closure or planned closure of more than 165 coal generating plants across the country, equating to over 22,000 megawatts of electricity. New Source Performance Standards being proposed by EPA will make it nearly impossible to build new coal-based power plants in the future. These regulations will further erode West Virginia’s coal economy.
