CORPS & EPA PUBLISH JOINT MITIGATION RULE |

Yesterday the U.S. Army Corps of Engineers and the Federal Environmental Protection Agency published a final mitigation rule in the Federal Register. Proposed in March 2006, the rule establishes new guidelines for all forms of compensatory mitigation under the “dredge and fill” program of Section 404 of the Federal Clean Water Act.
