Courts are not the proper forum for making rules in such situations
West Virginians have good reason to regulate how companies mine coal.
They have had to live with the consequences of reckless production
practices.
They also have reason to object to reckless judicial rule-making.
The public has, through its representatives in legislative bodies,
established rules for mountaintop removal mining. Environmental groups,
disapproving of those rules, seek to re-shape the regulations using the
courts.

The Pocahontas Coal Association will join the Bluefield Daily Telegraph on Tuesday, December 4th, to recognize the Boys High School Football Players of the Week as well as presenting the Player of the Year Award. Coal state governors Dec. 4 urged federal lawmakers to support coal technologies in the nation's next energy bill.
"If we're saying one thing to Washington, it's work collectively in a
nonpartisan way," said Gov. Joe Manchin during a news conference at an
energy summit at Stonewall Resort and Conference Center. "Coal has to
be part of the mix."

In late news, we just learned that the U.S. Senate today failed to pass a cloture motion to limit debate on the “Energy Independence and Security Act of 2007” (H.R. 6), thereby preventing a Senate floor vote on the bill as currently written. The motion failed by a vote of 53-42, falling seven votes shy of the 60 votes required to approve a cloture motion. This is good news as the bill will now be rewritten by the Senate to address the objectionable amendments from the House, before further Senate consideration. The plan is to have the rewritten bill ready for a vote next week.
