Governor Tomblin has appointed Speaker Rick Thompson as Secretary of Veterans Assistance, effective in mid-June. The Governor's press release is included below. As you would expect, the race to replace the Speaker started immediately! Likely candidates include House Finance Chairman Harry Keith White (Mingo), Kanawha County Delegate Doug Skaff, House Judiciary Chairman Tim Miley, and House Majority Leader Brent Boggs (Braxton). A Special Session for purposes of electing a new Speaker is expected to be called in mid to late June. |

CHARLESTON, W.Va. -Gov. Earl Ray Tomblin today announced the appointment of Speaker Rick Thompson as Cabinet Secretary of the Department of Veterans Assistance. The appointment will be effective following the retirement of Secretary Keith Gwinn.
"I want to take this opportunity to thank Secretary Gwinn, our first Secretary of The Department of Veterans Assistance, for his service to our state and his enthusiastic commitment to our veterans," Gov. Tomblin said. "Secretary Gwinn accomplished much during his tenure, including his role in helping to secure the largest federal grant for a state veteran's cemetery. I'm truly grateful for his service."

The Competitive Enterprise Institute (CEI) reported that the U.S. Senate Environment and Public Works Committee voted to send the nomination of Gina McCarthy to be EPA Administrator forward by a straight party line vote of 10 to 8. During the committee’s meeting, Senator David Vitter, ranking Republican, said that Acting Administrator Robert Perciasepe had made some real progress toward satisfying the committee Republicans’ five requests for more transparency. He added that if more progress were made, he would not try to block a vote on McCarthy’s confirmation by demanding a cloture vote, and that if EPA fully satisfied all five requests, he would vote for McCarthy. |

A press release announcing the representation and a picture of the #27 truck is included below. We appreciate Hillman and Eddie bringing national attention to the Association and the Friends of Coal as the race was broadcast on the Speed Channel Friday evening. |

The first Legislative Monthly Interim Meetings will be held in Charleston from May 20-22. In our continuing partnership with the WV Secondary Schools Activities Commission (SSAC) we have the opportunity to present the State Championship and Runners-up trophies to the final two teams and/or individuals in the championship events for each of the three classes (A, AA, AAA) in each sport. The individuals on each team also receive a Friends of Coal plaque to commemorate their and their team's achievements. We encourage our members to participate in these presentations and the remaining events include the following. CONCORD, N.C. – Hillman Racing today announced that the West Virginia Coal Association and the Friends of Coal organization will be the primary marketing partners on the No. 27 NASCAR Camping World Truck Series entry driven by Team 7 Motorsports driver Jeff Agnew at Charlotte Motor Speedway for Friday night’s N.C. Education Lottery 200.
Located in Charleston, W.Va., the West Virginia Coal Association is a trade association representing more than 90 percent of the state's underground and surface coal mine production. Its purpose is to have a unified voice representing the state's coal industry as well as increase emphasis on coal as a reliable energy source to help the nation achieve energy independence.

Congresswoman Shelley Capito has joined with co-sponsors Barr, Shimkus, Lummis, Stivers, Wagner, Johnson, Griffith, Whitfield, McKinley, and Latta to introduce the Coal Jobs Protection Act in the House. The bill number is H.R. 1829.
The bill proposes controls on the EPA in order to prevent the withdrawal (veto) of permits after issuance, as occurred with the Spruce permit. A companion bill in the U.S Senate is being sponsored by Senator Mitch McConnell. |

The Association filed comments earlier this week regarding the proposal from the federal Environmental Protection Agency (EPA) to add streams to the 303(d) list of impaired waters for the State of West Virginia.
EPA published a notice in the Federal Register on Monday, April 8, 2013 in which it proposed adding 255 additional stream segments to the list of impaired waters for the State of West Virginia. On March 25, 2013 EPA notified the state by letter that it was partially disapproving the state’s proposed 303(d) list of impaired waters. EPA’s partial disapproval was based on the state’s decision not to place additional streams on the list of impaired waters for biological impairment using the West Virginia Stream Condition Index (WV SCI).

Former Association Board member, Jim Thomas, II, passed away on Wednesday in Charleston. Jim was well known throughout the industry as he and his brother, Newt, operated Carbon Fuel for a number of years. Since his retirement, he had been in numerous statewide organizations and a wide variety of civic activities in Charleston and the Kanawha Valley. Jim was inducted in the West Virginia Coal Hall of Fame in 2000. Barlow Bonsall Funeral Home in Charleston is in charge of arrangements which are incomplete at this time. |

The WV Board of Coal Mine Health & Safety promulgated an "Emergency Rule" designed to close a major loop hole in the State's mandatory drug testing program.
The Board's "Emergency Rule", which becomes effective on July 1, extends the reporting and decertification requirements in current state law to all individuals who fail a drug or alcohol test prescribed under state law. Heretofore, only cases involving a positive drug test that resulted in discharge, were reported to the Office of Miners’ Health, Safety & Training for disciplinary action and suspension of mining certification privileges.

According to U.S. International Trade Commission data for Jan-Mar 2013, U.S. coal exports were up 11.2% y/y to 31.8 million tons. Metallurgical coal exports for this period increased 4% y/y to 18.2 million tons. The y/y growth is primarily attributable to thermal coal exports, which were up 23% y/y to 13.6 million tons for the same period. The March 2013 export figure totaled 13.6 million tons, up from 8.6 million in tons in February and represented the single largest ever month for U.S. coal exports. |
